Wife gets trial in legal malpractice suit.(Smith v. Hastie)

A Charleston County woman could go forward with her malpractice claim against the attorney who drew up a family limited partnership that cut off her property rights when she and her husband divorced, the Appeals Court has ruled. The panel pointed to testimony from an estate planning specialist as the basis for reversing the dismissal of the plaintiff's breach of fiduciary duty claim.
